Hyderabad: The Telangana High Court has refused to interfere, clearing the way for Nawab Najaf Ali Khan's partition suit over Nizam VII's palaces to a full trial.
In a significant setback to Azmet Jah and Shekhar Jah, who prosecuted the challenge through their so-called General Power of Attorney holders(GPA holders), Mohammed Fateh Faiz Bin Jung, the Telangana High Court has dismissed the civil revision petition No. 1742 of 2026, holding the same to be "devoid of merit".
The revision had been directed against the order of the Hon'ble XI Additional Chief Judge, City Civil Court, Hyderabad, which had earlier dismissed their application in I.A. No. 79 of 2024 seeking outright rejection of the plaint in O.S. No. 404 of 2021, the partition suit instituted by Nawab Mir Osman Ali Khan Bahadur, the VII Nizam of Hyderabad. The matter was contested before the Hon'ble High Court on behalf of his counsel, Mohd. Adnan.
Rejecting the challenge, the Hon'ble High Court held that its supervisory jurisdiction under Article 227 of the Constitution "is not to be substituted in the form of an appellate jurisdiction", and can be invoked only where there is jurisdictional error or a finding so contrary to law as to be perverse.
The Hon'ble High Court recorded that the plaintiff "prima facie has been able to make out the fact that he is also having a share in the suit schedule property", and held that the question of court fee "could be decided only in the course of trial after the parties lead their own evidence".
The Hon'ble Court concluded that "no strong case calling for an interference at this juncture" has been made out.
The suit filed by Nawab Najaf Ali Khan seeks partition and separate possession of five of the most prominent and historically significant palaces of the late Nizam VII, namely Falaknuma Palace, Chowmohalla Palace, Purani Haveli, King Kothi Palace, and Harewood and Cedars Bungalow situated in Tamil Nadu, and a declaration that the sale deed executed in respect of King Kothi/Nazri Bagh is void and illegal.
With the dismissal of the revision petition, the plaint stands, and the suit will now proceed to trial on merits before the City Civil Court, Hyderabad.
Truth will prevail
"Yet again, an attempt to throw out my suit without a trial has failed. The High Court has said in the clearest terms that these questions must be decided on evidence. The properties and heritage of my beloved grandfather, H.E.H. Nawab Sir Mir Osman Ali Khan Bahadur Nizam VII, belong collectively to all legitimate heirs, and not to any one individual. I have always asked only for a trial on merits, and I am confident that the truth will prevail.
